CONTRACT RIDER (NATIONAL/INTERNATIONAL)

 

   All clauses attached hereto form an integral part of this CONTRACT and must be strictly adhered to. We are flexible on most things on this rider but not on the day of the show. Any deviations from this rider that have not been cleared will result in a cancellation of the show. Some equipment selections (such as microphones) are merely a guide and if there are requirements that you need to discuss, then please do so in advance. Approval by Performer must be given, as there are to be no changes allowed on the day of show. We look forward to working with you to produce a show that is incredibly memorable for your venue for all the right reasons.

The term “Performer” in this document refers to the performing band, Fascination Street.  The term “Purchaser” refers to party(s) paying for Performer’s services.

1. Advertisment: Performer to receive billing as: “Fascination Street – The Look, The Sound and Feel of The Cure” in all print, audio, and marquee advertising.

2. Catering: Purchaser to provide eight full hot and healthy meals. Fast food is not acceptable. (Taco bell is fine for Evan, but not the rest of the band). Purchaser has the option of $15 buyouts for eight people ($120 total) should he/she not wish to provide the hot meal but should inform Performer seven days prior to performance and there must be a local restaurant nearby where ample seating is available.

Purchaser to provide the following beverages upon arrival (at time of load in) for the band and crew until the completion of Performer‘s performance:

·         3 (three) drink tickets for each band member good for beer and mixed drinks.

·         1 (one) case of bottled water cold, with ice. Tap water is not acceptable.

·         Coffee and/or tea available (sugar and cream to be supplied)

3. Air & Ground Travel: If event requires performer to fly, Purchaser agrees to provide all air travel accommodations with air travel confirmation (paid itinerary e-mailed to Performer) not less than 30 days prior to event. Travel must include round trip tickets for not less than six people. Air travel must also include ground transportation (taxi or shuttle must accommodate equipment and baggage) to hotel, to and from airport. Transportation must also include ground travel from hotel to venue and from venue to hotel. Rental vehicles are acceptable if supplied by purchaser and can accommodate Performer, crew, equipment and gear. Rental vehicles will also require an allowance of $50.00 (US) per day for fuel costs. Rental vehicles must include insurance.

4. Hotel: (if included in deal) Should hotel accommodation be provided, the hotel should be a minimum 3 star, clean, air conditioned, have en-suite bathrooms, cable/satellite television (with channels in English other than CNN and MTV), minibar or 24hr vending machine for drinks and a ground floor lockable room provided for storage of the band equipment. Actual number of rooms required will vary depending on number of crew, but will be confirmed in advance.

5. Dressing Room: Purchaser to provide Performer with a comfortable, private and secure dressing room (with easy access to one clean private bath room and to the stage) for the exclusive use of the Performer. Dressing room must accommodate adequate space for use of six to eight persons and not to be shared by other performers unassociated with Performer and its crew. The dressing room shall be clean, dry, well lit, adequately heated and/or air conditioned supplied with working and safe electrical outlets. The dressing room shall be secured when not in use, or while band is on stage. Full length mirrors should also be provided. Purchaser will also provide several clean, large towels for Performer’s use on stage and in the dressing room.

6. Soundcheck: Performer requires a private soundcheck at least two hours prior to doors opening, or four hours prior to performance with full access to stage, sound, and light systems for a period of not less than two (2) hours. Performer shall have first call on any available time for soundchecks. Any supporting act retains its right to a soundcheck subject to Performer’s use and time permitting.

7: Load In/Load Out: Performer requires ample secure parking spaces close to the stage door for a minimum of three (3) vehicles. Purchaser shall also provide minimum two (2) stronghands to assist with load in/load out of equipment. Purchaser will be charged $100.00 US per stagehand in the event that they are not in complete attendance for both load in and load out.

8. Lighting Requirements: Adequate stage lighting including moving fixtures to be provided with full control from FOH (Front of House). Fog machines, UV and minimum 2 strobe lights to be provided. One (1) lighting technician to be available during load in, soundcheck and duration of Performer’s Performance for instruction or operation should Performer not provide a lighting technician. Performer prefers as spectacular a lighting show as possible. If Performer uses our own lighting technician, Purchaser to provide a secure designated discreet area near the stage (with full view – front, side, or back) for light board technician to run effects and lights. Fog is typically used for effect on lasers and lights. If fog is a problem, it must be cleared in advance and a hazer would be used as a secondary option.

9. Equipment Safety: Purchaser shall be solely responsible for any harm, damage, loss, theft, or vandalism to Performer’s equipment and gear while in venue. Please see attached list of backline to be hired if applicable.

10. Storage: Purchaser to provide Performer with safe and secure area to store equipment and gear before, during, and after performance.

11. Merchandise: Performer will require a table in a well lit, secure and prominent space for display and sale of merchandise.

12. Guest List: Artist requires a minimum of twelve (12) guest list spots held or tickets for ticketed shows, not including industry attendees. If there is a problem with the guest list, we would be happy to discuss it after we’ve seen who actually shows up.

13: Stage and Sound Requirements: Performer requires a minimum of 16 channels on the mixing desk not to be touched between soundcheck and performance (FOH and Monitors but only 12 channels on monitors) plus whatever channels are used to return house effect units. Performer requires four discreet monitor mixes, one at the rear of the stage (drumfill with sub bass) and three at the front (center, SL + SR) plus stereo sidefills (if possible). Monitor wedges to be minimum 2-way active with 15” drivers and the drumfill must contain sub-bass. A separate monitor board must be provided with Performer’s channels not to be shared with any other band. Performer can provide our own FOH engineer but may require provision of a component monitor engineer who speaks good English. The FOH mixing desk should be closed as to allow no public access to the equipment. The system should be modern, of professional quality, run in stereo, be a minimum 3-way active with very powerful sub-bass, be properly limited and be capable of 120db SPL with full and even frequency coverage. All components of the sound system must be of the good quality and be from recognized professional manufacturers. Local crew to be co-operative and sober at all times. Please also provide talkback to stage from FOH. Microphones stated are examples and can be changed if approved beforehand. All effects returns can be run in stereo channels. Keyboards and drum effect pads are to be run in stereo channels. Guitar and bass can be run in normal channels.

Any queries regarding the sound set up or notification of any changes to these specifications should be addressed thirty (30) days prior to performance. A full system check must be sent for approval at least three weeks prior to performance. Examples of acceptable manufactures are attached. If the system does not match the above specifications, and there was no prior notification and agreement of any changes in writing, then it will be classed as a breach of contract on the part of the Purchaser, and the show will not proceed. (see Breach of Contract item 20).

14. Power: 220v on US Style plugs on stage and FOH. Please supply plug boards for each of the five stage positions. Mains supply to be of the highest standards and supply more than adequate power.

15. Deposit of guarantee & Payment: Purchaser agrees to pay a minimum deposit of 50% of the negotiated guarantee 30 days prior to event to reserve a performance date.  If Purchaser has provided travel accommodations, (lines 3 and 4), then at least a 25% payment of the negotiated guarantee must be paid 30 days prior to the event, and remainder of guarantee must be paid in full on the day of the event prior to performance. All payments must be in the form of US cash or wired transfers into Performer’s designated bank account. No checks or foreign currency will be accepted.

 

16. Breach Of Contract: This rider forms part of a legally binding contract between Performer and the Purchaser. Any variation to particulars deviated from this contract without prior notification and approval from Performer (in writing- email is acceptable) within the specified times listed above will be considered “breached” and therefore the show will be canceled, and any costs or guarantees will be considered a loss to the purchaser, and cannot be reclaimed.
